RICO Case Defense Examples:
- In 2001, F. Emmett Fitzpatrick and NiaLena Caravasos won significant victories in the highly publicized organized crime case entitled, "United States v. Merlino, et al." At the conclusion of a federal trial in the United States District Court for the Eastern District of Pennsylvania which lasted almost five months, the jury acquitted their respective clients of murder, attempted murder and racketeering charges.
News coverage at the time described Mr. Fitzpatrick as the "dean of criminal defense lawyers" and the "anchor of [the] defense team". (Philadelphia Daily News, 30 March, 2001). Ms. Caravasos was described as an "extremely thorough" and "tireless advocate [who] allows no legal issue to escape her attention" (Philadelphia Daily News, 30 March, 2001). In another article entitled "Mob On Trial: For The Defense ... The Greatest Lawyers On The East Coast", Ms. Caravasos, the "youngest and lone female attorney" in the case, was described as "a thorough advocate with courtroom poise beyond her years" (Philadelphia Daily News, 31 May 2001).
- In 1999, F. Emmett Fitzpatrick won a rare and precedent-setting victory when the Supreme Court of Pennsylvania freed his client, reputed organized crime figure Raymond Martorano, from prison on grounds of prosecutorial misconduct and double jeopardy. The Justices ruled, 5-4, that the former prosecutor's conduct throughout the trial had gone so far "beyond the bounds of legitimate advocacy" that it would not permit the case to be re-tried.
- In 1995, F. Emmett Fitzpatrick won acquittals at trial for two separate reputed mob figures who had been charged with federal violent crimes and racketeering offenses in the case entitled, "United States v. Stanfa et al.", which was tried in the United States District Court for the Eastern District of Pennsylvania.
